Ajay Langer Vice President, Sh. Viraaj Malhotra General Secretary, Sh. Rajesh Jain Secretary and Sh. Vivek Singhal Treasurer BBIA in respect of News Item published in today’s newspaper in respect of “Govt. sets into motion process for retrieval of unutilized land in all Indusial Estates”.

Members present in the meeting showed concern in respect of Govt. Order 233-Ind of 2021 dated 22-11-2021 issued by the Industries & Commerce Department for the Nomination of General Manager, JKSIDCO, Jammu and Kashmir Division as Member for Eviction Process with regard to cancellation of lease deed and eviction of allottees in Industrial Estates Managed by J&K SIDCO.

Sh. Lalit Mahajan, President BBIA  draws the kind attention of Sh. Ranjan Prakash Thakur (IRTS) Principal Secretary, Industries & Commerce Department, Jammu that Hundreds of Cases for the Renewal of Provisional Registration of Industrial Units, who has already taken effective steps in respect of the construction of Factory Building, Installation of Machinery and in some cases,  placed Orders for the Machinery,  awaiting the approval of the Apex Committee pending since long and also invite the attention towards the Govt. Order No.214-IND of 2021 dated 02-11-2021 for the Constitution of Sub-Committee for examining the proposal for the Grant of Extension in the validity of Provisional Registration in respect of Units which were provisionally registered prior to the Notification of J & K Industrial Policy 2021-30 in accordance with the directions issued in the meeting of 47th Apex Project Clearance Committee held on 02-09-2021 with the directions to submit the report within a period of seven days.

It is pertinent to mention here that numbers of Industrial Units having Permanent Registration with Industries Department closed since last few years due to unforeseen circumstances like non-availability of Supply Orders from Govt, Financial Constraints, Death of the Promoters, etc. and it is unjustified to Cancel the Lease Deeds of such closed units which will be amount to unnecessary Litigation as no such Clause incorporated in the Lease Deeds duly executed in the Court of Law.

We also draw the kind attention of Principal Secretary towards the Point No. 18.2 of Govt. order No. 129-IND of 2017 dated 07-06-2017 which is reproduced as under:-

“Once all the steps have been exhausted for the revival and rehabilitation of Sick Industrial Unit, the Govt. shall provide an exit route to the sick unit by allowing transfer of its ownership/leasehold rights to another entrepreneur provided all the liabilities are cleared.”

We request Sh. Sh. Ranjan Prakash Thakur (IRTS) Principal Secretary, Industries & Commerce Department, Jammu to kindly defer the decision taken to start the eviction process till the final decision taken in the next Apex Committee Meeting on the basis of the report to be submitted by the Sub Committee as per Govt.
