Chief Justice of India to Decide on Early Listing of Petitions Challenging Abrogation of Article 370

17-03-2023 : The Supreme Court has announced that it will consider the early listing of petitions challenging the Centre’s decision to abrogate provisions of Article 370, which provided special status to Jammu and Kashmir. The bench, comprising Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala, noted the urgency of the matter and will make a decision on the early hearing of the pleas. The pleas were previously mentioned before the bench on December 14, 2021, and on April 25 and September 23, 2021, a bench led by the then CJI N V Ramana had agreed to hear the petitions challenging the Centre’s decision.

The current five-judge bench will have to be reconstituted as two of the judges have retired. The case involves petitions challenging the constitutional validity of the Centre’s decision to abrogate provisions of Article 370 and the Jammu and Kashmir Reorganisation Act, 2019, which split the state into two Union Territories. The Centre’s decision to abrogate Article 370 revoked the special status of Jammu and Kashmir. The bench had previously declined to refer the matter to a larger seven-judge bench, stating that there was no conflict between the judgments.
