Delhi High Court Halts Discharge of Three Accused in TS Wazir Murder Case

JAMMU/Delhi, OCTOBER 24: In a significant development in the TS Wazir murder case, the Delhi High Court has intervened to put a halt to the discharge of three accused individuals who were earlier cleared of charges related to the tragic murder of National Conference leader Trilochan Singh Wazir.

The Delhi Police had taken action by moving the case to the High Court, seeking a reversal of the discharge of these three accused. The matter was brought before the Chief Justice, and following a thorough hearing of the revision petition submitted by Delhi Police, Justice Vikas Mahajan has temporarily suspended the discharge of the accused. The three individuals in question are Balbir Singh (known as Billa), Rajinder Chaudhary (alias Ganja), and Sudershan Singh Wazir.

The Delhi High Court has issued notices to the respondents and is currently awaiting their response. The next hearing on this matter is scheduled for December 13, 2023.

The backdrop to this legal development lies in a recent ruling by Delhi’s Tis Hazari Court, where three of the accused in the TS Wazir murder case were acquitted of various charges. It’s essential to note that one of the accused still faces charges related to murder, while another has been charged with the destruction of evidence.

The court’s decision, delivered by Additional Sessions Judge Hem Raj on October 20, 2023, acquitted Balbir Singh, Rajinder Chaudhary, and Sudershan Singh Wazir of all charges in this case. However, the court upheld charges against accused Harmeet Singh under Section 302 IPC.

Accused Harpreet Singh Khalsa was discharged from charges under Sections 302 IPC and 120B IPC but was charged with the offense under Section 201 (Destruction of evidence) IPC and 174A IPC.

This case pertains to the tragic homicide of Trilochan Singh Wazir, a former MLC from Jammu and Kashmir, who met his demise due to a single gunshot injury to the head. The incident occurred in Delhi in September 2021.

The Delhi Police had filed a charge sheet against several individuals, including Harmeet Singh, Harpreet Singh Khalsa, Rajinder Chaudhary, Balbir Singh, and Sudarshan Singh Wazir, for their alleged involvement in offenses under sections 302/201/174A/120B/34 IPC. In the course of the investigation, the Delhi Police submitted four charge sheets, including three supplementary charge sheets.

The first charge sheet was filed against Harmeet, Rajinder, and Balbir, with the first supplementary charge sheet introducing Forensic Science Laboratory (FSL) results. Accused Khalsa was then forwarded for trial through a second supplementary charge sheet, and accused Sudarshan was likewise sent for trial via a third supplementary charge sheet. The third supplementary charge sheet indicated substantial evidence against Harmeet, Khalsa, Rajinder, Balbir, and Sudarshan.

Notably, the investigation into Harjinder Singh Raina and Jagpal Singh is still ongoing, as confirmed by the court.

The case was initiated when the police received information about a foul odor emanating from a flat located on the second floor of a building in Basai Darapur. The flat was in the possession of accused Khalsa and owned by Kulbhushan. Upon investigation, a blood-stained mattress was discovered in one of the rooms, and the lifeless body of Trilochan Singh Wazir was found in one of the bathrooms, with his face covered by black polythene and cloth.

Upon identifying the deceased as Trilochan, a case was registered based on a statement provided by Bhupender Singh, the complainant and brother of the victim. Singh narrated that his brother, Trilochan, was a resident of Jammu and a well-known figure, and his family was residing in Canada.

According to Singh, accused Harmeet and Khalsa had frequented his brother, who was scheduled to leave Canada on September 2, 2021. Singh further alleged that Khalsa informed him that Trilochan had been quarantined in Frankfurt, Germany. Subsequent investigations revealed inconsistencies in these accounts.

Singh maintained that his brother, Trilochan, had been murdered by Khalsa and Harmeet and suggested a conspiracy behind the killing. He went on to claim that Sudarshan and Surender Singh Kala had prior conflicts with the deceased, with previous threats issued against Trilochan. Singh alleged that this enmity and conspiracy ultimately led to the death of his brother.
