Government Grants Notional Increment to Retirees, Boosting Pension Calculations for June 30 and December 31 Pensioners

Supreme Court Rulings Lead to Notional Increment for Central Government Retirees, Enhancing Pension Benefits

JAMMU, Oct 14: In a significant move, the Government of India has granted a notional increment to Central Government employees who retired on June 30 or December 31. The increment, aimed at enhancing the calculation of pensionary benefits, follows a series of judicial decisions, including a landmark judgment from the Madras High Court and subsequent endorsement by the Supreme Court.

The legal rulings have established a precedent for granting increments to retirees, recognizing their years of service and maintaining that those who retired on the specified dates are entitled to this financial adjustment. The Supreme Court’s judgment reinforced this entitlement, compelling the government to issue specific instructions for implementing the notional increment.

According to the government memorandum, the increment will be used exclusively for pension recalculations, ensuring that only the pension amount is affected while other retirement benefits remain unchanged. The framework for this increment is guided by the Central Civil Services (Revised Pay) Rules and relevant provisions within the Fundamental Rules that oversee the salary and increment structure for government employees.

To qualify for this benefit, employees must have demonstrated satisfactory service and maintained good conduct up until their retirement. The government’s directive to comply with court orders serves as an interim measure, as a review petition is still pending before the Supreme Court. The provisional nature of these instructions aims to prevent further legal complications and ensure consistency in the application of the increment.

The government has instructed all its departments and agencies to adhere strictly to these guidelines, ensuring that eligible retirees receive the notional increment in their pension calculations. The interim orders are designed to provide clarity and prevent confusion while the legal process continues, highlighting the government’s commitment to upholding judicial decisions and ensuring fair treatment for its retired employees.
