New Delhi, Oct 14: The inheritance dispute over late businessman Sunjay Kapur’s estate has taken a dramatic turn, as Karisma Kapoor’s children, Samaira and Kiaan, challenged the authenticity of their father’s alleged will before the Delhi High Court.
Senior Advocate Mahesh Jethmalani argued that the purported digital will could not have been signed by Sunjay Kapur, highlighting that “in certain crucial places in the alleged will, the feminine form of testator is used.” The court was informed that the document repeatedly refers to Sunjay Kapur as “she” and “her”, which Jethmalani called “not just implausible but deeply incriminating.”
Quoting a clause from the will, Jethmalani noted: “Signed and declared by Sunjay Kapur the testatrix above named as and for her last will.” He added, “This is an absurdity… it shows the audacity of those presenting this document in court. Sunjay Kapur, known for his precision and pride, could never have signed a will referring to himself in feminine terms. The document destroys its own credibility.”
The lawyer also questioned the will’s preparation and origins, pointing out that there is no physical handwriting, no photographic evidence, and only an incomplete digital footprint. The witnesses to the will have yet to file detailed affidavits, leaving critical questions unanswered. Jethmalani further criticized the omission of Sunjay Kapur’s mother, Rani Kapur, calling it a deliberate attempt to erase her from the estate.
Alleging an “estate takeover under the guise of widowhood,” Jethmalani said Priya Kapur now controls a large part of the estate. He highlighted multiple errors in the will, including misspelled names, wrong addresses, an informal tone, missing signatures, and unclear origins, arguing these were inconsistent with Sunjay Kapur’s meticulous nature.
Priya Kapur’s lawyer dismissed the petition as motivated by the “greedy motives” of Karisma Kapoor’s children. Jethmalani retorted, “Everything they receive comes from their grandmother and father. Your greed, Madam, is far greater and it’s written into every line of this will.”
The Delhi High Court is set to resume hearings in the matter on October 15, as the legal battle over the authenticity and validity of Sunjay Kapur’s alleged will continues.
