Congress Decries BJP’s Alleged Move to Nominate MLAs, Warns of Democratic Fraud in J&K

Jammu Oct.  04: Congress has vehemently opposed the move of the nomination of 5 MLAs before the Govt. formation in J&K & termed any such move as an attempt to commit fraud with democracy & mandate of the people, as well as the basic spirit of the constitution.

Addressing a press conference at PCC Jammu today, JKPCC working President Raman Bhalla, PCC Sr. Vice President & Chief Spokesperson Mr. Ravinder Sharma , Vice President Incharge HQ Ved Mahajan along with others said that any such attempt shows the desperation of BJP to manipulate numbers, although BJP  no way can form the government. by any means.

 Mr. Sharma said under the Constitutional scheme of things, the Lt. Governor has to act on the aid & advice of the council of ministers, and it would be a misuse of the provision of nomination if it is used to convert the majority into a minority & vice versa if any such situation emerges after counting. He asserted that Congress- NC would get a comfortable majority to form the government, but this move is anti-democratic & fraudulent with democracy & mandate of the people, who have cast their votes to elect 90 MLAs to form the government by majority.

It will be a fraud on democracy and mandate of people if any such action of nominations is contemplated before govt. formation in J&K UT . IT is the right of elected MLAs, whosoever party or coalition gains majority in elections to form a new government. because people have voted them to power

It can’t be the spirit & mandate of the constitution & democracy to authorize a person to convert a majority into a minority & vice versa otherwise also. Under the constitution the governor has to act on the aid & advice of the council of ministers, so the Lt. Governor has to nominate  5 MLAs, after the new government. takes over & recommends the names for the nomination. Any such move would be against the basic concept of democracy & spirit of the the constitution  if nominations is undertaken prior to Govt. formation.

He further added that the congress party had favored due representation in assembly to POJK  refugees, KPs & other minorities, before the delimitation commission & submitted a written memorandum besides raising strong objection to the proposed report, demanding a sangha assembly (Sikkim) type reservation of seats to them. He explained that Budhists monastic monks & nuns of 111 minorities have been provided an assembly seats  in Sikkim in which only they can contest & cast their votes. Same pattern of elections would have given chance to KPs & POJKs people & other minorities to send real elected representatives from amongst them but the BJP betrayed them all. What is the logic of giving only one seat to 12 to 14 POJK community against the promise of 8(eight)  Seats to them by BJP.

Sharma said probably BJP had kept this provision of nomination with a view to play this fraud with the mandate of people, to add to the BJP t.ally

Congress said that let the new govt. take over and then nominate these 5 persons on merit & give them all powers and voting rights, etc like it used to be the case with the two women MLAs always nominated in the past by the governor on the aid & advice of the elected govt.  PCC General Secretary Narinder Sharma, PCC Chief Coordinator Neeraj Gupta, PCC Secretary and Spokesperson Sahil Sharma were also present.

Raising another issue of incident of attempt to attack on former Dy C.M. Tara Chand at his residence in Khour, Congress leaders took serious note of inaction on the part of the police. No arrests have been made so far despite the election commission taking cognizance of the complaint of Shri Tara Chand. If a former Speaker and Ex-Dy. C.M.  is not safe and no action is taken in the matter, what must be the fate of other candidates and common people they added.
