New Delhi, 19-02-2024 : In response to a petition alleging irregularities in the Chandigarh mayoral elections, the Supreme Court issued a directive on Monday, mandating the production of ballot papers before the court on Tuesday. The apex court further instructed the registrar general of the High Court to appoint a judicial officer to procure the ballot papers and associated video recordings for examination. Notably, the court emphasized the need for security measures to safeguard both the officers involved and the integrity of the records.
During the proceedings, Anil Masih, the returning officer for the Chandigarh mayoral polls, admitted to tampering with the ballot papers, confessing to marking ‘X’ on eight allegedly “defaced” ballots. The court condemned Masih’s actions, asserting that his interference with the electoral process warrants prosecution. The court’s stern stance underscores the gravity of the situation and the imperative of upholding democratic principles.
The hearing coincided with the recent defection of three AAP municipal councillors to the BJP, raising concerns about potential “horse-trading.” The court acknowledged the seriousness of these developments, highlighting the need to address such practices that undermine the integrity of democratic processes.
This is not the first time the court has scrutinized the conduct of the returning officer. In a previous hearing on February 5, the court rebuked Masih for defacing the ballot papers, likening his actions to “murder and mockery” of democracy. As part of its measures to uphold electoral integrity, the court had also ordered the preservation of ballots and video recordings of the poll proceedings.
