High Court Keeps Decision Pending in MLA Mehraj Malik’s PSA Case

Jammu and Kashmir High Court seeks further submissions before deciding on Malik’s habeas corpus plea challenging PSA detention

Jammu, Feb 23: The Jammu and Kashmir and Ladakh High Court on Monday reserved its order on a petition challenging the detention of AAP MLA and Jammu & Kashmir unit president, Mehraj Malik.

Malik was detained under the stringent Public Safety Act (PSA) on September 8 last year, accused of disturbing public order, and has been lodged in Kathua jail since. In response, he filed a habeas corpus petition on September 24, contesting the legality of his detention and seeking Rs 5 crore in compensation.

The case was heard by Justice Mohammad Yousuf Wani, who has now reserved the matter for final pronouncement. Both Malik’s legal team and the State have been granted one week to submit written synopses or additional documents, if desired, Advocate Appu Singh Slathia confirmed.

Speaking on the development, Slathia, also an AAP spokesperson, said the legal process has been long and challenging but expressed confidence in the judiciary, urging Malik’s supporters and party activists to remain calm and patient.
