US Prosecutors Seek Continued Custody for Tate Brothers Amid UK Extradition Fight

MIAMI, Aug 11: US prosecutors have urged a federal court to keep social media personalities Andrew Tate and Tristan Tate in custody while they contest extradition to the United Kingdom, where they face serious criminal allegations including rape and human trafficking.

Prosecutors made the request in a filing submitted Monday, arguing that the brothers pose a significant flight risk and potential danger to the community. Their response came three days after defence lawyers sought their release from custody.

A federal court hearing scheduled for Thursday is expected to determine whether the brothers will remain detained or be released while the extradition process moves forward. The proceedings could take several months.

The Tates have repeatedly denied the allegations against them.

Prosecutors cite wealth, passports and international ties

According to the US Attorney’s Office, the brothers face a strong presumption against release because the case involves international extradition. Prosecutors pointed to the seriousness of the allegations in Britain, as well as claims arising from the brothers’ previous legal proceedings in Romania.

The filing said the allegations involving human trafficking, rape and assault, combined with claims that the brothers attempted to intimidate witnesses in Romania, raise concerns about public safety.

Prosecutors also cited what they described as the brothers’ access to substantial wealth, multiple passports and international connections. Their refusal to voluntarily return to Britain was presented as an additional factor supporting continued detention.

The defence has argued that the brothers should qualify for release under exceptional circumstances. Their lawyers said their high public profile makes it difficult for them to disappear and noted that they have routinely shared their whereabouts on social media.

The defence also pointed to the brothers’ compliance with restrictions imposed during earlier proceedings in Romania as evidence that they are not a flight risk.

Extradition process could take months

Britain has until around mid-September to submit supporting evidence to the US State Department as part of the extradition process. The defence has warned that the brothers could remain at the Federal Detention Center in Miami for months while the case progresses.

A formal extradition hearing has not yet been scheduled. The brothers are currently being held in a special unit at the Miami facility for security reasons.

UK allegations expand legal battle

British prosecutors have brought additional allegations involving four new complainants. The cases reportedly concern incidents dating from 2010 to 2017 and include accusations of rape, assault, human trafficking and offences involving child sexual abuse material and extreme pornography.

The brothers were already facing charges in Britain linked to three other complainants. Those allegations involve rape, bodily harm, human trafficking and controlling prostitution for financial gain and relate to alleged incidents between 2012 and 2015.

Andrew and Tristan Tate have denied the British allegations and have consistently disputed accusations made against them in other jurisdictions.

Romanian proceedings remain unresolved

The brothers relocated to Romania in 2016 and were arrested there in 2022 over allegations that they were involved in recruiting women for sexual exploitation. They have denied wrongdoing.

The Romanian case has faced a series of legal and procedural obstacles and has yet to reach a final resolution. Their lawyers have said Romanian authorities have approved a British extradition request that would take effect after the Romanian proceedings conclude.

Andrew Tate, 39, gained international attention after appearing on the British reality television programme Big Brother. He later built a large online following through content focused on wealth, masculinity and controversial views about women.

He has more than 10 million followers on X, while several other major social media platforms have previously banned him over policy violations.

Tristan Tate, 38, has worked with his brother on several business ventures, including online entertainment businesses.

The upcoming detention hearing is expected to be a key early stage in the brothers’ latest legal battle as US authorities consider Britain’s extradition request.
