CBK Chargesheets PHE Employee for Fraudulent Claim of Migrant Relief
EOW Kashmir says accused fraudulently obtained over ₹18 lakh by misrepresenting service status
Kashmir, Jan 19 : The Economic Offences Wing (EOW) Kashmir of Crime Branch Jammu and Kashmir (CBK) has filed a chargesheet against a former Public Health Engineering (PHE) Department employee for allegedly fraudulently availing migrant relief worth more than ₹18 lakh by misrepresenting his employment status and unlawfully registering as a migrant along with his family members.
Chargesheet Filed in Jammu Court
In a statement, EOW Kashmir said the chargesheet has been produced before the Court of the 19th Electricity Magistrate, Jammu, against Mohd Hussain Shah, a resident of Syedapura, Shopian, presently residing at Nunar, Kawabagh, Ganderbal. The accused is a retired employee of the PHE Department, Ganderbal Division.
The chargesheet relates to allegations that the accused illegally registered himself and his family as migrants and obtained migrant relief amounting to ₹18,30,265, despite being ineligible for the benefits.
Misrepresentation of Service Status Alleged
According to EOW, the investigation was initiated following a written complaint alleging misuse of government welfare schemes. During the probe, it was prima facie established that the accused had deliberately misrepresented his service status and suppressed material facts to secure migrant registration.
Investigators found that the accused continued to receive migrant relief while being in active government service during the relevant period, which rendered him ineligible for such benefits.
Offence Under Section 420 RPC
The investigation further revealed that the accused’s actions resulted in a wrongful loss to the government exchequer and a corresponding wrongful gain to himself.
Based on material evidence collected, EOW said the acts constitute an offence punishable under Section 420 of the Ranbir Penal Code (RPC). After completing all statutory and procedural requirements, the chargesheet was formally submitted to the competent court for judicial scrutiny.

The Economic Offences Wing Kashmir reiterated its commitment to curb economic offences and to protect public resources by acting firmly against the misuse of government welfare schemes.
