CPI(M) Leader M Y Tarigami Criticizes Article 370 Abrogation as an Attack on Jammu and Kashmir’s Rights and India’s Foundations

22-08-2023 : M Y Tarigami, a prominent leader of the Communist Party of India (Marxist) or CPI(M), has strongly criticized the abrogation of Article 370, asserting that it not only constitutes an “assault” on the rights of the people of Jammu and Kashmir but also undermines the very foundations of India. Speaking at a press conference, Tarigami highlighted that if the Supreme Court does not intervene to halt what he terms an “unconstitutional move” by the Central Government, the consequences will be far-reaching and profound.

Tarigami expressed his satisfaction with the arguments put forth by the lawyers representing the petitioners challenging the Article 370 abrogation. He emphasized that the events of August 5, 2019, which saw the revocation of Article 370, stand as unconstitutional and a mockery of the Indian Constitution.

He went on to underline that the ramifications of the abrogation extend beyond the borders of Jammu and Kashmir. According to him, this move doesn’t just infringe upon the rights of the region’s residents, but also strikes at the very core of India’s democratic framework. He cautioned that if the Supreme Court doesn’t intervene to address this unconstitutional act, the consequences could be far-reaching and transformative.

Tarigami stressed the uniqueness of Jammu and Kashmir’s historical situation, highlighting the region’s special negotiation of the terms of accession to the Union of India. He refuted the argument that Article 370 was merely a temporary provision, pointing out that it stipulates that abrogation requires the President of India to secure approval from the constituent assembly of Jammu and Kashmir, not from the state assembly or the governor.

The CPI(M) leader expressed optimism that the Supreme Court will deliver justice and uphold the safeguards and rights granted to the people of Jammu and Kashmir under the Indian Constitution. He clarified that the intention is not to seek favor, but to advocate for the restoration of the rights enshrined in the Constitution.
