Crime Branch Kashmir charge sheets two in ₹13 lakh MBBS admission fraud case

Education fraud exposed: Crime Branch files charge sheet under IPC Sections 420, 120-B

SRINAGAR, JANUARY 16: The Economic Offences Wing of the Crime Branch Kashmir on Friday filed a charge sheet in a case involving alleged fraud in which a complainant was cheated of ₹13 lakh on the pretext of securing an MBBS admission for his son.

In an official statement, the Crime Branch Kashmir said the charge sheet in FIR No. 10/2024 has been submitted before the Court of the Sub-Judge, Baramulla, under Sections 420 (cheating) and 120-B (criminal conspiracy) of the Indian Penal Code.

The accused have been identified as Aquib Javeed and Mohammad Ahtesham Ahmad, both sons of Mohammad Ayoub and residents of Ring Road, Adarsh Nagar, Gulbarga in Kalaburagi district of Karnataka.

According to the Crime Branch, the case originated from a written complaint alleging that the complainant was approached by one Dr. Shamsu-Din, an employee of Al-Amin Medical College, who assured him that an MBBS seat could be arranged for his son through Aquib Javeed. Trusting this assurance, the complainant was induced to part with ₹13 lakh.

However, the investigation revealed that despite receiving the money, neither was the complainant’s son admitted to any medical college nor was the amount returned. Acting on the complaint, the Police Station Economic Offences Wing of CBK initiated a detailed probe into the matter.

During the course of investigation, it emerged that Aquib Javeed, in criminal conspiracy with his brother Mohammad Ahtesham Ahmad, had allegedly deceived the complainant by falsely promising admission to his son in KBN Medical College, Bijapur. The Crime Branch said the evidence collected during the investigation established the commission of offences under Sections 420 and 120-B IPC against both accused.

As the accused were not available during the course of proceedings, the CBK said the charge sheet has been filed before the competent court in absentia after initiating proceedings under Section 512 of the Criminal Procedure Code, which deals with prosecution in the absence of accused persons.
