OBC holds protest at Jammu
Jammu 25th July 2023: In a joint Protest was held by O.B.C. Mahasabha, All India Backward Classes Federation and All J&K Welfare forum of Srinagar and Presidents of different castes and communities under the banner of O.B.C. Adhikar Tringa Yatra. In this Protest Sh. Mohan Lal Pawar General Secretary O.B.C Mahasabha criticised the discriminatory behaviour of Sh. Narinder Modi, Prime Minister of India, Sh.Amit Shah, Home Minister of India, Lieutenant Governor of Jammu & Kashmir and of Sh.G.D.Sharma, Chairman JK-UT Socially & Educationally Backward Classes towards JK-UT OBC masses and Vice-Chancellor of Jammu University.
During the Protest Sh. Kasturi Lal Basotra, Chairman O.B.C Mahasabha strongly condemned the attitude of Modi Govt. as the B.J.P Modi Govt. has betrayed from its promise made in 2014 at Maulana Azad Stadium Jammu and at Hiranagar during the Assembly election of Jammu & Kashmir and also in 2019.Instead of implementing 27% reservation in JK-UT Govt.services as per Supreme of India Judgment dt.16.11.1992 on Mandal commission report and in Panchyati Raj system and in Urban Local Bodies ( as of Article 243D-6 and 243T-6) the Modi Govt.start diluting the OSC/OBC reservation in JK-UT by start Inducting the Upper caste masses under the garb of RESIDENT OF BACKWARD AREA( R.B.A)10% reservation + Actual line of control+I.B( A.L.C ) 4%and Phari speaking peoples( P.S.P) 4% in Socially & Educationally Backward classes as clearly mentioned in the S.O:-127 dt.20.04.2020 an amendment to S.R.O 294 of 2005 as the Modi Govt.has continued the STATE RESERVATION ACT-2004 which was framed under article-370.Where as for upper
caste masses (other than Schedule caste/Schedule Tribe and OBCs) the Modi Govt. implemented 10% EWS reservation in 2019 by inducting Articles 15(6) and 16(6) in the Indian constitution.So the Reservation to upper castes masses under R.B.A+A.L.C+ I.B+ P.S.P under Socially & Educationally Backward Classes ( as O.B.C’s)is constitutionally illegal.
Further Sh.Faquir Chand Satia, President A.I.B.C.F detailed during the protest that the Modi Govt. constituted a SOCIALLY & EDUCATIONALLY BACKWARD CLASSES COMMISSION in March 2020 by appointing a 92-year-old Justice Sh.G.D.Sharma as its Chairman and Two Non-O.B.C members under article 340 of Indian constitution for inclusion & Exclusion of Mandal Commission identified castes and communities in the JK-UT lists of SOCIALLY & EDUCATIONALLY BACKWARD CLASSES. The Name of this commission is BACKWARD CLASSES COMMISSION but Modi Govt. constituted with the NON-OBC’s Chairman and its members only with the intention to dilute the OSC/OBC reservation by inducting the upper castes/classes and other castes as mentioned in S.O.:-537 dt 19.10.2022 of JK-UT Govt. who not KAMEENS but landlords and are not in the Report of Mandal commission the lists of JK-UT. The Union Govt.and JK-UT Govt. should disband this commission and constitute a BACKWARD CLASSES COMMISSION as the para number 123A of A.I.R 1993-94 regarding the Judgment dt.16.11.1992 on Mandal commission report in the case “INDIRA SAWHNEY Vs UNION OF INDIA for inclusion & Exclusion of castes and communities.
Further Sh.Mohd.Shabir Sambiyal, President Dhobi Welfare Central Committee detailed during the protest that in the recruitment of Professors/Assistant Professors/Associate Professors in Jammu University the Vice-Chancellor of Jammu University as adopted the discriminatory way of OBC reservation under the influence of Modi Govt.by giving only 2% reservation in the recently advertised posts instead of 27% as per UNIVERSITY GRANTS COMMISSION norms. Moreover the OBC Scholars in this University are facing discrimination during Ph.d after the submission of Ph.d . Further a fake OBC certificate holder has been allowed for M.phil/P.hd during the year-2016 which the OBC organizations has pointed out several times but this university is hiding this matter for a long time. All the reserved categories of JK-UT are getting the reservation in P.hd entrance but due to the discriminatory attitude of Jammu/Kashmir Universities towards OSC/OBC students these universities are not giving their reservation in P.hd entrance
