Supreme Court Defers Decision on Adani Group’s Proposed Thermal Power Plant in UP

New Delhi, Feb 13: The Supreme Court on Thursday declined to pass any orders regarding the Adani Group’s proposed thermal power plant in Uttar Pradesh, asking both the State and Central governments to submit their responses before any directive is issued.

Bench Emphasizes Balance Between Development and Environment

A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and Vipul M. Pancholi highlighted the need to balance environmental concerns with developmental requirements. Addressing senior advocate Sanjay Parikh, representing an environmental activist, the bench said, “The State may be power deficient. We can’t pass orders like this without reviewing the government responses.”

Environmental Concerns Raised

Parikh submitted that the proposed plant is located near forested areas, potentially threatening sloth bears and other wildlife. He also noted that the Adani Group received environmental clearance while petitions on the matter were pending before both the Supreme Court and the National Green Tribunal.

Government Responses Awaited

Chief Justice Kant noted the complexities involved, stating that objections often arise related to power generation, forests, or rivers, but development projects cannot be stalled indefinitely. The court directed Additional Solicitor General Aishwarya Bhatti, representing the Centre, to file a detailed response explaining how ecological concerns would be addressed. The UP government and the Adani Group were also allowed to submit their responses.

The Supreme Court’s decision underscores the judiciary’s cautious approach in balancing environmental protection with India’s energy development needs.
