Supreme Court Judge Withdraws from Case After Reserving Verdict

Bench recalls earlier order after judge discovers past professional link with petitioner

NEW DELHI: In a rare development, a judge of the Supreme Court of India, Justice K V Viswanathan, recused himself from a case after the conclusion of hearings and reservation of judgment, prompting the matter to be listed for fresh consideration.

The case involved a petition filed by Alchemist Asset Reconstruction Company Pvt Ltd (AARC), which had been heard by a bench comprising Justices J B Pardiwala and K V Viswanathan. The bench had reserved its verdict on March 17 after completing arguments.

Subsequently, Justice Viswanathan realised that he had previously represented AARC during his long legal career before his elevation to the bench. Acting promptly to avoid any conflict of interest, he chose to step aside from the case.

Taking note of the development, the bench recalled its earlier order reserving the judgment and directed that the matter be placed before the Chief Justice of India for reconstitution of a new bench and fresh hearing.

In its order, the court stated that the recusal was necessary as Justice Viswanathan had appeared as counsel for the appellant in earlier proceedings related to the corporate insolvency resolution process. The move underscores the judiciary’s commitment to transparency and maintaining the highest standards of impartiality.
