03-07-2023 : On July 11, the Supreme Court of India is scheduled to hear a batch of petitions challenging the abrogation of Article 370 and the subsequent bifurcation of the state of Jammu and Kashmir into two Union Territories (UTs). A five-judge Constitution bench will preside over the crucial hearing, where the legal validity of the Center’s decision will be scrutinized.
The Chief Justice of India (CJI), Ranjan Gogoi, has constituted the bench comprising Justices N V Ramana, S K Kaul, R Subhash Reddy, B R Gavai, and Surya Kant. This move follows a decision made on August 28 to refer the petitions to a larger bench, given the significance and complexity of the issues involved.
Prior to this, a bench headed by the CJI dealt with other related petitions concerning the constitutional changes in Jammu and Kashmir. It was decided that all matters relating to these changes would now be adjudicated by a three-judge bench headed by Justice Ramana.
Numerous petitions have been filed in the Supreme Court challenging the Center’s decision to abrogate Article 370 and divide the state into Union Territories. Additionally, there are separate petitions regarding the lockdown and restrictions imposed in the region following the constitutional changes.
Among the petitions is one filed by the National Conference (NC), represented by Lok Sabha MPs Mohammad Akbar Lone and Justice (retired) Hasnain Masoodi. The total number of petitions on different aspects of Article 370 and the Jammu and Kashmir restrictions stands at 12.
