Delhi HC Declines Stay on Dhurandhar: The Revenge OTT Release in Tirchi Topiwale Copyright Dispute, Orders T-Series to Deposit Rs 50 Lakh

Court asks T-Series to deposit Rs 50 lakh, says compensation can be awarded later if copyright infringement is established

NEW DELHI, May 15: The Delhi High Court has declined to stay the OTT release of Dhurandhar: The Revenge amid a copyright dispute involving the alleged unauthorised use of the popular song “Tirchi Topiwale” from the 1989 film Tridev.

Justice Tushar Rao Gedela refused to grant interim relief to Trimurti Films Private Limited, which had moved the court seeking an injunction against the use of the original song and its recreated version, “Rang De Lal (Oye Oye)”, in the film and on streaming platforms.

At the same time, the court directed Super Cassettes Industries Pvt. Ltd. (T-Series) to deposit Rs 50 lakh before the Registrar General within four weeks. The amount will be placed in an interest-bearing fixed deposit receipt (FDR) with an auto-renewal clause until the final outcome of the case.

Trimurti Films argued that its 1988 agreement with T-Series granted only limited audio rights and did not authorise the synchronisation or adaptation of the song in any new cinematographic work. The company alleged infringement of its rights over the literary, musical and sound recording components linked to the track.

The respondents, including B62 Studios Pvt. Ltd. and Jio Studios, contested the plea and accused the petitioner of withholding material facts. They pointed out that songs from Tridev had been featured earlier in films such as Azhar and K.G.F: Chapter 1 without any legal challenge from Trimurti Films.

Refusing to halt the release, the court observed that monetary compensation could adequately address the issue if the plaintiff ultimately succeeds in establishing ownership and infringement during trial proceedings.

Dhurandhar: The Revenge is scheduled to begin streaming on Netflix from May 15, 2026. Reports also indicate that an extended “Raw & Undekha” version of the film, featuring additional uncensored footage, will be made available in India on JioHotstar.
