Jammu and Kashmir High Court introduces live streaming of court proceedings

New rules set up framework for live streaming in Jammu and Kashmir High Court

27-02-2023: On Monday, the Jammu and Kashmir and Ladakh High Court issued the “Live Streaming and Recording of Court Proceedings Rules of the High Court of Jammu & Kashmir and Ladakh, 2023”. These rules establish the necessary infrastructure and framework for live streaming and recording of court proceedings in order to increase transparency, inclusivity, and access to justice.

The notification specifies that live streaming will start when the bench assembles and directs the court staff to begin proceedings, and will end when the bench concludes for the day. There will be a 10-minute delay in the streaming, subject to change by the Court.

The notification also outlines that if a judge on the bench wishes to opt out of live streaming while delivering an order or oral judgment, the live streaming will be paused, and a message stating “Order dictation in progress” will be displayed. The live streaming will also be paused when the bench rises for recess or other reasons, and a message stating “Court not in session” will be displayed.

Matrimonial cases, cases related to sexual offenses, gender-based violence cases, POCSO matters, and other proceedings are excluded from live streaming. The rules allow for objections to live streaming to be raised by any party during the case’s institution or at a later stage, and the bench will make the final decision on whether to permit live streaming based on the principles of an open and transparent judicial process.
