Colorado Supreme Court Delivers Landmark Ruling: Bars Donald Trump from State’s 2024 Ballot Over Jan 6 Insurrection Role

Web Desk, 20-12-2023 : In a groundbreaking decision, the Colorado Supreme Court has barred former President Donald Trump from the state’s 2024 ballot due to his involvement in the January 6 Capitol insurrection. The court’s ruling stems from the 14th Amendment’s “insurrectionist ban,” disqualifying individuals who “engaged in insurrection or rebellion” after taking an oath of office from holding public office, including the presidency.

The bombshell 4-3 ruling represents the first successful lawsuit among the numerous legal challenges filed against Trump. Filed on behalf of six Colorado voters by the government watchdog group Citizens for Responsibility and Ethics in Washington and two law firms, this case stands out as a significant legal victory against the former president.

The Colorado Supreme Court justices, all appointed by Democratic governors, delivered the majority ruling, with three justices dissenting. However, the ruling will not take effect until January 4, pending Trump’s appeal to the U.S. Supreme Court, which has the potential to settle the matter conclusively.

The court’s decision emphasized that Trump is disqualified under Section 3 of the 14th Amendment, characterizing his inclusion on the state’s primary ballot as a wrongful act under the Election Code. The majority opinion expressed the court’s recognition of the gravity of the issues at hand and its commitment to impartially apply the law, irrespective of public sentiment.

Furthermore, the court explicitly directed Secretary of State Jena Griswold not to list Trump’s name on the 2024 presidential primary ballot and prohibited the counting of any write-in votes cast for him.

In response to the judgment, the Trump campaign swiftly announced its intention to file an appeal with the United States Supreme Court. Campaign spokesperson Steven Cheung criticized the Colorado Supreme Court’s decision, labeling it as “completely flawed” and asserting confidence in a favorable ruling from the higher court. The campaign also sought a stay of the decision, denouncing it as undemocratic.
