Interim order stresses compliance with statutory qualification norms prescribed under RTE, NCTE and UGC laws
NEW DELHI, Sept 8: The Supreme Court has restrained the appointment of teachers in schools and colleges who do not possess the qualifications prescribed under the relevant education laws, stressing the need to maintain statutory standards in teaching appointments.
The interim direction covers qualifications prescribed under the Right to Education Act, the National Council for Teacher Education (NCTE) Act and the University Grants Commission (UGC) Act.
The court’s intervention comes amid continuing concerns over the appointment of teaching personnel without the qualifications mandated for their respective positions. The order underscores that educational institutions must follow the prescribed eligibility requirements while making appointments.
For school teachers, the applicable qualifications are governed by the statutory framework under the Right to Education Act and NCTE regulations. In higher education, appointments are subject to qualification standards laid down under the UGC framework.
The direction is expected to reinforce compliance with established recruitment norms and prevent institutions from appointing candidates who do not meet the required academic or professional criteria.
