Sub Judice Matter: BJP Chief Stresses Restraint on Article 370 Discussions

04-07-2023 : BJP’s Ravinder Raina, the president of Jammu and Kashmir, recently emphasized the importance of refraining from making comments on the sub judice matter of Article 370. He pointed out that the Supreme Court of India is set to hear the Article 370 case through a 5-judge bench from July 11th onwards. When a case is sub judice, it is considered inappropriate to make any comments or statements that may influence the court’s decision.

Raina expressed his belief that the Supreme Court’s decision would bring an end to the political propaganda and narratives perpetuated by certain parties and factions. He asserted that the court’s judgment would be solely based on the merits of the case, taking into account thorough arguments and counter-arguments presented during the hearing.

The matter in question revolves around the abrogation of Article 370, which granted special status to the erstwhile state of Jammu and Kashmir. Nearly four years after the government’s decision to abrogate the article, the Constitution bench, headed by Chief Justice of India DY Chandrachud, will commence the hearing on various pleas challenging this decision.

Raina also emphasized that when Article 370 was initially implemented, extensive deliberations took place in the Constituent Assembly. Similarly, when the article was eventually abrogated in 2019, detailed discussions were held in both houses of Parliament, leading to amendments being carried out.

On the topic of the Uniform Civil Code (UCC), Raina referred to Prime Minister Narendra Modi’s remarks and asserted that the final decision on it would consider the well-being of all individuals. He reiterated the government’s commitment to inclusive decision-making, ensuring that consensus and welfare would be the guiding principles in moving forward with the UCC, ultimately benefiting society as a whole. He highlighted that Law Minister Arjun Ram Meghwal has sought public views and suggestions on the UCC, signaling a consultative approach.

Additionally, Raina praised the announcement of allotting five marlas (1,360 square feet) of land each to landless beneficiaries of the Pradhan Mantri Awas Yojana-Gramin (PMAY-G). This initiative aims to provide housing to those in need, aligning with the government’s focus on welfare and inclusive development.
