J&K Govt Says CSC Report on Reservation Submitted to Council of Ministers, Final Decision Awaited from Competent Authority
The Jammu and Kashmir government confirms submission of Cabinet Sub-Committee report on reservation to the Council of Ministers, says existing policy aligns with constitutional and judicial principles.
Srinagar, Oct 30: The Jammu and Kashmir government on Thursday said that the Cabinet Sub Committee (CSC) on reservation has submitted its report to the Council of Ministers and that the final decision will be taken after obtaining approval from the competent authority.
In a written reply to a question raised by Peoples Conference President Sajad Gani Lone and Independent MLA Shabir Kulley, the Minister in charge of the General Administration Department informed the Assembly that the CSC, after detailed deliberations and consultations with stakeholders, has completed and submitted its report to the Council of Ministers.
“The report shall be finalized in due course of time after obtaining the requisite approval of the competent authority,” the minister said.
The government maintained that the existing reservation policy broadly aligns with constitutional provisions and the principles laid down by the Supreme Court in the Indira Sawhney vs. Union of India (1992) judgment.
Referring to the landmark judgment, the minister noted that the Supreme Court had held that reservations should ordinarily not exceed 50% of available vacancies. “However, it is also clarified that this ceiling is not an absolute rule and may be relaxed in extraordinary circumstances, where exceptional or peculiar facts of a particular state or region justify such deviation,” the minister added.
The government also clarified that it does not maintain region wise or district wise details of selections for junior scale posts in the Jammu and Kashmir Administrative Service, Jammu and Kashmir Police (Gazetted) Service, and Jammu and Kashmir Accounts Service, stating that such data is not recorded at that level.
