J&K LMD Cracks Down on Private Hospital for Non-Standard Billing Practices and Overcharging Violations
JAMMU, Oct 15: In a significant enforcement action aimed at upholding Legal Metrology norms and protecting consumers from unfair practices, the Legal Metrology Department (LMD) has fined a Punjab-based private hospital chain operating in Jammu’s Greater Kailash area. Specializing in orthopedic surgeries and bone-related treatments, the hospital was found guilty of conducting commercial transactions using non-standard units of measurement, violating the provisions of the Legal Metrology Act, which mandates the use of accurate and standardized units in all business dealings, including those related to medical devices.
The case emerged following a special inspection led by the Legal Metrology Department’s Jammu District team, acting on the directives of Anuradha Gupta, Controller of Legal Metrology Department, J&K. The inspection was part of a broader initiative to regulate commercial practices in the healthcare sector and enforce compliance with the Legal Metrology Act, ensuring that consumers are not exploited by improper billing practices and that fair trade is maintained within the sector.
During the inspection, officials discovered that the hospital had been using non-standard units of measurement in its billing for medical services and devices. Specific discrepancies were identified, particularly in the quantities (whether in weight, measure, or number) of surgical materials or dressing supplies used during procedures, which were not accurately reflected in the patients’ bills. These inconsistencies raised concerns about the transparency and accuracy of the hospital’s billing practices.
After a case was registered for breaching the relevant provisions of the Legal Metrology Act, the hospital management acknowledged the violations and chose to settle the matter through departmental compounding by paying a fine of Rs. 20,000.
In a recent statement, the Legal Metrology Department, J&K, emphasized that all medical services, including transactions involving medical devices, are subject to the Legal Metrology Act. The department reiterated that, as per the standing norms, pre-packaged commodities must be sold at or below their Maximum Retail Price (MRP). The department urged consumers to be vigilant and to carefully review bills issued by hospitals. In cases of discrepancies or overcharging, consumers are encouraged to approach the Legal Metrology Department for swift resolution.
Additionally, Anuradha Gupta, Controller of Legal Metrology, appealed to traders and service providers, including hospitals, to voluntarily comply with the prescribed Legal Metrology standards in all transactions. She stressed the importance of fair and transparent billing, ensuring that patients and their families receive accurate information and are not subject to overcharging. This action serves as a warning to all healthcare providers to adhere strictly to legal guidelines and maintain transparency in their operations.
