BBIA Resent Eviction Process Of Non Functional Permanent Registered Units by Industries Department

Jammu, 12-03-2024: An Urgent meeting of Bari Brahmana Industries Association (BBIA) was held under the Presidentship of Sh. Lalit Mahajan in the presence of Sh. Tarun Singla, Sr. Vice President, Sh. Ajay Langer Vice President, Sh. Viraaj Malhotra General Secretary, Sh. Rajesh Jain Secretary and Sh. Vivek Singhal Treasurer BBIA in respect Final Notice issued by Industries Department as per the list received by the Association to Non-Functional Permanent Registered Units to Reactivate/Revive their Units within 10 days to avoid Eviction Proceedings.

Members present in the meeting raised serious concerns in respect of the List of Units sent to the Association which is not correct as it has been observed that nos. of Units has been already De-registered / Additional Line/ Changed their Line of activity as per the permission granted by Industries Department and the requisite information already available with General Manager, DIC, Jammu Office. Moreover, nos. of Units already working but the same has been declared as Non-Functional resulting great resentment amongst the Unit Holders as majority of the Units are owned by Sons of the Soil.

It is pertinent to mention here that keeping in mind to provide the relief to Closed/Sick Units the Exit Route option has already been given in the Industrial Policy 2016 Point No. 18.2 of Govt. order No. 129-IND of 2017 dated 07-06-2017 which is reproduced as under:-

“Once all the steps have been exhausted for the revival and rehabilitation of the Sick Industrial Unit, the Govt. shall provide an exit route to the sick unit by allowing transfer of its ownership/lease hold rights to another Entrepreneur provided all the liabilities are cleared.”

It is worthwhile t to mention here that, as per the Lease Deed Executed between the SIDCO/SICOP and Unit Holders by the virtue of which for which the Lease Hold Rights have been granted for a  particular period and the Unit Holders are paying the SIDCO/SICOP dues as per the Bills raised by the Corporation from time to time, it is unjustified on the part of Industries Department to take such type of action which may be resulting into unnecessary litigation.

We appreciate the steps taken by the Industries Department working the able guidance of Hon’ble Lt. Governor Sh. Manoj Sinha for the Speedy Development of New Industrial Estates to provide Land to Prospective Entrepreneurs to setup their Units under the Package of Incentives Notified by Govt. of India for which the allotment process already in progress in the New Industrial Estates being Developed in due course but it is unjustified on the part of the Industries Department to harass such Unit Holders whose Units has been closed due to Unviable/Sickness by the issuance of such type of notices in-spite of the facts that no such clause has been mentioned in the Lease Deed & Provision for the transfer of  Leasehold Rights already made by then Govt. in Industrial Policy 2016 for providing the relief to such units.

We request Hon’ble Lt. Governor Sh. Manoj Sinha, Chief Secretary  Sh. Atal Dulloo, IAS, and Commissioner/Secretary Sh. Vikramjit Singh, (IPS) for immediate withdrawal of such Notices issued by the Industries Department to provide relief to such Units which have been closed due to Unforeseen Circumstances/Unviable/Sickness by providing an Exit route for transferring their Lease Hold Rights to Prospective Investors.
