Industrial Sector in J&K Grapples with Delays in Consent to Establish/Operate for Orange/Red Category
Jammu, 26-06-2023: The working of Orange and Red Category Existing Units as well as Prospective Investors suffering very badly due to the non-Issuance of Consent to Establish and Consent to Operate by J & K State Pollution Control Committee as the Post of Chairman laying vacant since 01-05-2023.
Unit Holders are not able to get their bank Limits renewed and cannot apply for the grant of Fiscal Incentives as the Pollution Control Valid Consent to operate is one of the requisite Document for the Renewal of Bank Limits and approval of Fiscal Incentives resulting the Unit Holders are not in a position to apply for claiming Fiscal Incentives under the UT/Central Government package of Incentives.
While highlighting the issue, Sh. Lalit Mahajan Chairman Federation of Industries Jammu, draws the kind attention of Hon’ble Lt. Governor Sh. Manoj Sinha in respect of the piling of Files in the Office of the Chairman Pollution Control Committee for the issuance of Consent to Establish/Operate for the Orange/ Red Category to the Industrial Units pending since 1st May 2023 due to the vacant post of Chairman as the previous Chairman has retired on 30-04-2023.
It is pertinent to mention here that due to the non-issuance of Consent to Establish in respect of Orange/Red Category, the registration of the Prospective Investors under the NCSS 2021 is pending as without the valid Consent to establish it is not possible for the Unit Holders to apply for the Registration on the Portal. The matter has already brought into the notice of the Principal Secretary Forest Department but nothing has been done so far resulting in the Unit Holders are suffering very badly.
In respect of Existing Units, the Files related to the Renewal of Consent to Operate in respect of the Orange/Red Category are also pending with the Office of the Chairman, and in the absence of same the Unit Holders are not able to get their bank Limits renewed and cannot apply for the grant of Fiscal Incentives as the Pollution Control Valid Consent to operate is one of the requisite Document for the Renewal of Bank Limits and approval of Fiscal Incentives resulting the Unit Holders are not in a position to apply for claiming Fiscal Incentives under the UT/Central Government package of Incentives.
It is worthwhile to mention here that massive Investment proposals have been approved by the Industrial Department and the Land Lease has been granted by Industries Department but due to the non-availability of Consent to Establish the Unit Holders cannot obtain the Provisional Registration from the Industries Department resulting delay reported in the Implementation of project and we term it as a set back to the Ease of Doing Concept adopted by the Pollution Control Department.
We request Hon’ble Lt. Governor Sh. Manoj Sinha for his kind intervention into the matter for appointment of Chairman J & K Pollution Control Committee and in case of any further delay the Delegation of Powers should to given to Member Secretary J & K Pollution Control Committee for the clearance of pending files of Industrial Units till the appointment of New Chairman Pollution Control Committee.
