Industrial Units in Limbo: Delays in Consent to Establish/Operate Pose Major Challenges for Orange/Red Category
INDUSTRIAL SECTOR SUFFERING DUE TO NON ISSUANCE OF CTE/CTO FOR ORANGE/ RED CATEGORY BY J&K POLLUTION CONTROL COMMITTEE - BBIA
Jammu, 05-06-2023: An Urgent meeting of the Bari Brahmana Industries Association was held today under the Chairmanship of the Presidentship of Sh. Lalit Mahajan in the presence of Sh. Tarun Singla Sr. Vice President, Sh. Ajay Langer Vice President, Sh. Viraaj Malhotra General Secretary, Sh. Rajesh Jain Secretary and Sh. Vivek Singhal Treasurer BBIA Association and other members of the Association.
During the course discussions the member present in the meeting raised serious concerns in respect of the piling of Files in the Office of Chairman Pollution Control Committee for the issuance of Consent to Establish/Operate for the Orange/ Red Category to the Industrial Units pending since 1st May 2023 due to vacant post of Chairman as the previous Chairman has retired on 30-04-2023.
It is pertinent to mention here that due to non-issuance Consent to Establish in respect of Orange/Red Category, the registration of the Prospective Investors under the NCSS 2021 is pending as without the valid Consent to establish it is not possible for the Unit Holders to apply for the Registration on the Portal. The matter has already brought to the notice of the Principal Secretary Forest Department but nothing has been done so far resulting in the Unit Holders are suffering very badly.
Consent to Establish/Operate for the Orange/ Red Category to the Industrial Units pending since 1st May 2023 due to vacant post of Chairman as the previous Chairman has retired on 30-04-2023.
In respect of Existing Units the Files related to the Renewal of Consent to Operate in respect of the Orange/Red Category are also pending with the Office of the Chairman and in the absence of same the Unit Holders are not able to get their bank Limits renewed as the Pollution Control Valid Consent to operate is one of the requisite Document for the Renewal of Bank Limits resulting the Unit Holders are not in a position to apply for claiming Fiscal Incentives under the UT/Central Government package of Incentives.
It is worthwhile to mention that under the Ease of Doing Concept, the Power should be delegated to the Member Secretary of the Committee for the issuance of Consent to Establish/Operate for early disposal of files and the approval of the Chairman should be mandatory for the issuance of Red Category Consent to Establish/Operate.
We request Hon’ble Lt. Governor Sh. Manoj Sinha for his kind intervention into the matter for the Delegation of Power to Member Secretary J & K Pollution Control Committee for the clearance of pending files of Industrial Units till the appointment of the New Chairman Pollution Control Committee.
