Jailed JKLF Chief’s Unauthorized Courtroom Entry: Delhi Prisons Takes Action Against Officials

22-07-2023 : The Department of Delhi Prisons has faced a security breach that led to the suspension of four officials, including a deputy superintendent, following the unexpected physical appearance of jailed JKLF (Jammu Kashmir Liberation Front) chief Yasin Malik in the Supreme Court. Yasin Malik is currently serving a life sentence in Tihar jail for his involvement in a terror funding case.

The incident occurred on a Friday when Yasin Malik, accompanied by armed security personnel and without the court’s permission, was brought to the high-security premises of the apex court in a prison van. To the surprise of everyone present in the packed courtroom, he walked in. This unauthorized presence of a high-risk convict like Malik in the court premises created a flutter and raised serious security concerns.

In response to this security breach, the Department of Delhi Prisons took swift action and suspended one deputy superintendent, two assistant superintendents, and one head warder, as they were found to be prima facie responsible based on a preliminary inquiry. The suspension aimed to hold these officials accountable for their roles in allowing Yasin Malik’s unauthorized appearance in court.

To further investigate the matter, Deputy Inspector General (Prisons-Headquarters) Rajiv Singh was appointed to conduct a detailed inquiry. The objective was to identify any other officials who might have contributed to the security lapse and fix responsibility for the incident. The DIG Tihar’s thorough investigation aimed to ascertain the extent of the breach and prevent such incidents from happening in the future.

During the court proceedings, Solicitor General Tushar Mehta expressed surprise at Yasin Malik’s presence in the Supreme Court. He informed the bench, consisting of Justice Surya Kant and Justice Dipankar Datta, that there is a proper procedure for high-risk convicts to be allowed into the courtroom to argue their case personally. However, the bench clarified that they had neither granted Malik permission nor passed any order allowing him to argue his case in person on that particular day.

Yasin Malik appeared in the Supreme Court during a hearing on an appeal filed by the Central Bureau of Investigation (CBI) against a September 20, 2022 order of a trial court in Jammu. The trial court’s order pertained to the 1989 kidnapping of Rubaiya Sayeed, the daughter of the then Union minister Mufti Mohammad Sayeed.

The incident raised serious questions about the security protocols and adherence to procedures within the prison department and the court system. Such breaches can have severe implications for the safety and integrity of judicial proceedings. The suspension of the officials involved serves as a reminder of the critical need for maintaining a robust security infrastructure to ensure the smooth and secure functioning of the justice system. The detailed inquiry conducted by DIG Tihar is crucial in identifying the lapses and implementing corrective measures to prevent similar occurrences in the future.
